{"id":3376,"date":"2021-04-05T19:01:13","date_gmt":"2021-04-05T17:01:13","guid":{"rendered":"https:\/\/www.pv-lfs-tirol.at\/?p=3376"},"modified":"2021-04-13T21:54:28","modified_gmt":"2021-04-13T19:54:28","slug":"jubilaeumszuwendung","status":"publish","type":"post","link":"https:\/\/www.pv-lfs-tirol.at\/?p=3376","title":{"rendered":"Jubil\u00e4umszuwendung"},"content":{"rendered":"\n<p><strong><span class=\"has-inline-color has-vivid-red-color\">Jubil\u00e4umszuwendung f\u00fcr pragmatisierte Lehrer\/innen<\/span><\/strong><\/p>\n\n\n\n<p>Gem\u00e4\u00df \u00a7 20c des Gehaltsgesetzes kann Lehrer\/innen aus Anlass der Vollendung einer Dienstzeit von <strong>25 bzw. 40 Jahren<\/strong> eine Jubil\u00e4umszuwendung gew\u00e4hrt werden. Als Dienstzeiten gelten dabei allerdings auch \u201eVordienstzeiten\u201c, die bei der Ermittlung des<br>Besoldungsdienstalters (Vorr\u00fcckungsstichtages) gem\u00e4\u00df \u00a7 12 Abs. 2 und 3 des Gehaltsgesetzes zur G\u00e4nze angerechnet wurden und f\u00fcr die Vorr\u00fcckung tats\u00e4chlich wirksam sind (d.h. abz\u00fcglich eines \u201e\u00dcberstellungsverlustes\u201c). Diese Einbeziehung von \u201eVordienstzeiten\u201c erkl\u00e4rt auch, warum zwei Lehrpersonen mit gleichem Dienstantritt die Jubil\u00e4umszuwendung zu unterschiedlichen Zeitpunkten bekommen k\u00f6nnen.<br>Zur Kl\u00e4rung der Anspruchsberechtigung wird von der Dienstbeh\u00f6rde ein Jubil\u00e4umsstichtag ermittelt, der bei dieser erfragt werden kann. <\/p>\n\n\n\n<p>Die Auszahlung der Zuwendung erfolgt an dem auf den Jubil\u00e4umsstichtag folgenden 1. J\u00e4nner oder 1. Juli. Ein Ansuchen ist nicht erforderlich.<\/p>\n\n\n\n<p>Nach einer Dienstzeit von <strong>25 Jahren<\/strong> werden <strong>zwei Monatsbez\u00fcge<\/strong> und<\/p>\n\n\n\n<p>nach einer Dienstzeit von <strong>40 Jahren vier Monatsbez\u00fcge<\/strong> als Jubil\u00e4umszuwendung ausbezahlt.<\/p>\n\n\n\n<p>Unter Monatsbezug ist dabei jener Betrag zu verstehen, der Lehrer\/innen \u201egem\u00e4\u00df ihrer besoldungsrechtlichen Stellung\u201c f\u00fcr den Monat geb\u00fchrt, in den das Dienstjubil\u00e4um f\u00e4llt. Das bedeutet, dass vollbesch\u00e4ftigten und teilbesch\u00e4ftigten pragmatisierten Lehrer\/innen in gleicher Weise der volle Monatsbezug (ohne Sonderzahlung) des Monats, in den das Dienstjubil\u00e4um f\u00e4llt, geb\u00fchrt. Bei der Berechnung des Monatsbezuges werden Dienstzulagen (Leiterzulage) sowie eine Dienstalterszulage mit eingerechnet.<br>Anl\u00e4sslich der Versetzung in den Ruhestand nach Erreichung des gesetzlichen Pensionsalters (65 Jahre) kann die Jubil\u00e4umszuwendung im Ausma\u00df von vier Monatsbez\u00fcgen auch dann gew\u00e4hrt werden, wenn eine Dienstzeit von mindestens 35 Jahren vorliegt. Sind die Voraussetzungen f\u00fcr die Gew\u00e4hrung einer Jubil\u00e4umszulage erf\u00fcllt und ist die Lehrperson jedoch vor der Auszahlung verstorben, kann die Zuwendung den versorgungsberechtigten Hinterbliebenen ausbezahlt werden.<\/p>\n\n\n\n<p><br><span class=\"has-inline-color has-vivid-red-color\"><strong>Jubil\u00e4umszuwendung f\u00fcr Vertragslehrer\/innen<\/strong><\/span><\/p>\n\n\n\n<p>Im \u00a7 22 Abs. 1 VBG ist festgelegt, dass f\u00fcr die Jubil\u00e4umszuwendung der Vertragslehrer\/innen die einschl\u00e4gigen Bestimmungen f\u00fcr die Beamt\/innen sinngem\u00e4\u00df gelten.
